Chapter 4: Quick view of the bail bond process

Here’s a brief summary of what happens from arrest to case closed:

1. Defendant is arrested.
The defendant is arrested by a law enforcement agency and taken to the police station for booking or incarceration.

2. Defendant calls attorney, family or friend for help.

3. Attorney, family member or friend calls bail agent.

4. Bail agent acquires collateral and a premium from defendant or co-
signer and secures bond.
All necessary paperwork is completed.

5. Bond is posted.
Bail agent visits jail and posts bond for the defendant’s release.

6. Defendant is released.
Court date is set.

7. Defendant makes court appearance.
Defendant makes court date with or without attorney. Case is eventually decided.

8. Collateral is released.
Bond is exonerated based on court appearance and court decision.

9. File Closed.
Upon receiving notice of exoneration, the bail agent closes the defendant’s file and returns any collateral that was deposited.
